Terms and Conditions for Agritourism Event Ticket Purchase

Event Date: All dates in October 2024

**1. Introduction

These Terms and Conditions ("Agreement") govern the purchase of tickets for agritourism events hosted by Geiger Pioneer Farm LLC ("Farm"). By purchasing a ticket, you ("Customer") agree to abide by the terms outlined herein.

**2. Definitions

"Event" refers to any agritourism activity hosted by the Farm, including but not limited to farm tours, demonstrations, and interactive agricultural experiences.
"Ticket" refers to a pass or voucher purchased for access to the Event.
"Farm" refers to Geiger Pioneer Farm LLC.
**3. Ticket Purchase and Payment

3.1 Payment: Full payment must be made at the time of purchase. Tickets are non-refundable except as specified in Section 6.

3.2 Ticket Transfer: Tickets are not transferable without prior written consent from the Farm. Unauthorized resale of tickets is prohibited.

**4. Event Details

4.1 Event Schedule: The Farm reserves the right to modify the Event schedule, including date, time, and content, with or without prior notice.

4.2 Admission: The Farm reserves the right to refuse admission or remove any person from the Event for inappropriate behavior or failure to comply with Farm rules.

**5. Liability and Assumption of Risk

5.1 Assumption of Risk: The Customer acknowledges that participation in agritourism activities involves inherent risks, including but not limited to personal injury, property damage, and agricultural hazards. The Customer voluntarily assumes all such risks.

5.2 Liability Waiver: To the fullest extent permitted by law, the Farm, its owners, employees, agents, and affiliates are not liable for any injury, loss, or damage sustained by the Customer arising from participation in the Event.

5.3 Indemnification: The Customer agrees to indemnify and hold harmless the Farm from any claims, damages, or losses arising from their participation in the Event.

**6. Cancellation and Refund Policy

6.1 Event Cancellation: If the Farm cancels the Event, the Customer will be entitled to a full refund or rescheduled ticket, as determined by the Farm.

6.2 Customer Cancellation: Tickets are non-refundable once purchased. In cases of extreme circumstances, the Farm may, at its sole discretion, issue a refund or credit towards a future event.

**7. Compliance with Laws

7.1 Florida Statutes: This Agreement is governed by the laws of the State of Florida, specifically Title XXXV Chapter 570 of the Florida Statutes, which pertains to agriculture and agritourism.

7.2 Compliance: The Customer agrees to comply with all applicable local, state, and federal laws and regulations.

**8. Privacy

8.1 Data Collection: The Farm collects and stores personal information provided by the Customer for the purpose of processing ticket purchases and communicating Event-related information.

8.2 Data Use: The Farm will not share or sell personal information to third parties except as required by law or for the purpose of providing the Event.

**9. Governing Law and Dispute Resolution

9.1 Governing Law: This Agreement is governed by and construed in accordance with the laws of the State of Florida.

9.2 Dispute Resolution: Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with Florida law.

**10. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

**11. Entire Agreement

This Agreement constitutes the entire agreement between the Customer and the Farm regarding the ticket purchase and supersedes all prior agreements or understandings, whether written or oral.

**12. Acknowledgment

By purchasing a ticket, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.

While we strive to create a safe environment, we cannot be held liable for injuries that may occur on our property, including but not limited to bug bites, sunburn, or accidents resulting from reckless behavior. Children must be supervised by an adult at all times.
